Terms of Service

These Terms of Service ("Terms") govern your use of the BuildPredict AI platform ("Service") operated by BuildPredict AI Ltd ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

BuildPredict AI is a construction profitability risk prediction platform. The Service allows you to upload construction documents (invoices, quotes, contracts), extract cost data using AI, detect risk signals, and generate risk assessments to support bidding decisions.

Important: AI-generated predictions, risk scores, and cost extractions are provided as decision-support tools only. They do not constitute financial, legal, or professional advice. You should always exercise independent professional judgement when making business decisions.

2. Accounts

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately if you suspect unauthorised access to your account
  • One person or entity per account; accounts are non-transferable
  • You must be at least 18 years old to use the Service

3. Subscription & Billing

Plans

  • Free - Limited to 2 projects per month with basic features
  • Pro - Unlimited projects, advanced risk scoring, PDF reports, and priority support
  • Enterprise - Custom pricing with dedicated support and SLA

Payment

  • Paid subscriptions are billed monthly or annually in advance via Stripe
  • All prices are in British Pounds (GBP) and exclude VAT where applicable
  • You authorise us to charge your payment method on a recurring basis
  • Failed payments may result in suspension of your account after a grace period

Cancellation & Refunds

  • You may cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of the current billing period
  • We do not provide prorated refunds for partial billing periods
  • We reserve the right to offer refunds at our discretion

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Upload malicious files, viruses, or harmful content
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Reverse-engineer, decompile, or extract source code from the Service
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Resell, sublicense, or redistribute the Service without our written consent
  • Upload content that infringes on intellectual property rights of others

5. Your Data & Intellectual Property

You retain ownership of all documents and data you upload to the Service. By uploading content, you grant us a limited licence to process, analyse, and store your data solely for the purpose of providing the Service.

We may use anonymised, aggregated data derived from your usage to improve our AI models and the Service. This data cannot be used to identify you or your projects.

6. AI Predictions Disclaimer

The Service uses artificial intelligence and machine learning to extract costs, detect risks, and generate profitability predictions. These outputs are probabilistic estimates based on the data provided and should be treated as supplementary information, not definitive assessments.

  • AI predictions may contain inaccuracies or errors
  • Risk scores and cost extractions are not guarantees of project outcomes
  • We recommend human review of all AI-generated outputs before making decisions
  • We are not liable for business decisions made based on the Service's outputs

7. Limitation of Liability

To the maximum extent permitted by law, BuildPredict AI Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service.

Our total aggregate liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

9. Termination

  • You may close your account at any time by contacting us
  • We may suspend or terminate your account if you violate these Terms
  • Upon termination, your access to the Service will cease immediately
  • We will retain your data for 90 days after termination, then permanently delete it
  • Provisions that by their nature should survive termination will do so

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
